Terms of Service

1. Agreement to Terms

By accessing or using the services provided by Viinzo Marketing (“we,” “us,” or “our”), including our website at viinzomarketing.com and any related services such as A.I. voice receptionists, smart site builds, CRM platforms, automation workflows, and payment processing facilitation, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Services Provided

Viinzo Marketing provides A.I. and automation solutions for small businesses, including but not limited to: custom smart site builds, 24/7 voice A.I. receptionists, missed call text-back systems, web chat widgets, unified inbox management, CRM and pipeline management, automated Google review requests, calendar integrations, custom workflow automation, monthly performance reports, and zero-fee payment processing facilitation through our partner, Real Merchant Services.

3. Client Responsibilities

• You agree to provide accurate and complete information when signing up for our services or submitting forms (including the free mockup request).
• You are responsible for maintaining the confidentiality of any account credentials we provide.
• You agree not to use our services for any unlawful purpose or in violation of any applicable laws or regulations.
• You are responsible for providing timely feedback and approvals needed to complete deliverables such as site builds and automation setups.

4. Pricing & Payment

• Service pricing is as displayed on our pricing page at the time of purchase. We reserve the right to update pricing with 30 days' notice to existing clients.
• Monthly subscription fees are billed on a recurring basis. One-time setup fees are billed upon commencement of services.
• All fees are non-refundable unless otherwise stated in writing. Setup fees cover initial build and configuration work that begins immediately upon agreement.
• Late or failed payments may result in suspension of services until the balance is resolved.

5. Cancellation & Termination

• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing cycle. No partial refunds will be issued for unused time within a billing period.
• We reserve the right to suspend or terminate your access to services if you violate these terms, fail to make payment, or engage in conduct that is harmful to our business or other clients.
• Upon termination, we will provide a reasonable window to export or transfer your data. After that period, we are not obligated to retain your data.

6. Intellectual Property

• All custom websites, designs, automations, and A.I. configurations built by Viinzo Marketing remain our intellectual property until full payment has been received.
• Upon full payment, you receive a non-exclusive license to use the deliverables for your business. Underlying platform tools and templates remain our property.
• You retain ownership of your business content, logos, images, and branding materials provided to us.

7. Third-Party Services

Our services may integrate with or rely on third-party platforms (e.g., CRM software, telephony providers, payment processors, calendar services). We are not responsible for the availability, performance, or terms of these third-party services. Your use of such platforms is subject to their respective terms and conditions.

8. Limitation of Liability

To the maximum extent permitted by law, Viinzo Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, loss of data, or business interruption, arising out of or in connection with your use of our services. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that our A.I. systems will be error-free, that all calls will be handled perfectly, or that specific business results (e.g., lead volume, revenue increases) will be achieved. Results vary based on industry, market conditions, and client participation.

10. Indemnification

You agree to indemnify, defend, and hold harmless Viinzo Marketing, its owners, employees, and partners from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Arizona.

12. Changes to These Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
